Quick answer

Except where the owner takes production in kind or a title or entitlement dispute would affect distribution, Montana makes royalties interest-bearing if the operator does not pay within 120 days after the initial oil or gas under the lease is marketed, then within 60 days for oil and 90 days for gas (MCA § 82-10-103). Late royalties bear interest at the maximum rate allowed under MCA § 31-1-107, and an owner who makes written demand may sue if the payor does not account and pay within 60 days, with attorney fees to the successful party.

## First payment deadline

Unpaid royalties bear interest if the operator does not pay within 120 days after the initial oil or gas produced under the lease is marketed.

Royalties on the initial production must be paid within 120 days after that oil or gas is marketed, or the unpaid royalties bear interest. ([MCA § 82-10-103(2)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0030/0820-0100-0010-0030.html))

> Statute text “If the operator under an oil and gas lease fails to pay oil or gas royalties to the royalty owner or the owner's assignee within 120 days after the initial oil or gas produced under the lease is marketed”

## Later payments

For later production the statute sets 60 days for oil and 90 days for gas. The text says 'within 60 days for all oil and 90 days for all gas produced and marketed' without stating the starting point explicitly.

Ongoing royalties must be paid within 60 days for oil and 90 days for gas produced and marketed, or the unpaid royalties bear interest. ([MCA § 82-10-103(2)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0030/0820-0100-0010-0030.html))

> Statute text “and within 60 days for all oil and 90 days for all gas produced and marketed, the unpaid royalties must bear interest”

## Minimum payment and aggregation

The operator may pay semiannually (six months' royalties together) when the aggregate is less than $50, and annually when the aggregate is less than $10.

The operator may remit six months' royalties semiannually when the aggregate is under $50, and annually when the aggregate is under $10. ([MCA § 82-10-103(2)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0030/0820-0100-0010-0030.html))

> Statute text “The operator may remit semiannually to a person entitled to royalties the aggregate of 6 months' royalties whenever the aggregate amount is less than $50 and annually whenever the aggregate amount is less than $10.”

## Interest on late payments

Except where the owner takes production in kind or a title or entitlement dispute would affect distribution (MCA 82-10-103(4)), late royalties bear interest from the date due until paid at the maximum rate authorized under MCA 31-1-107. That section allows a written-agreement rate up to the greater of 15% or 6 percentage points above the Federal Reserve H.15 bank prime rate. The statute does not say whether the interest is simple or compound.

Unpaid royalties bear interest at the maximum rate authorized under MCA 31-1-107 from the date due until paid. ([MCA § 82-10-103(2)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0030/0820-0100-0010-0030.html))

> Statute text “the unpaid royalties must bear interest at the maximum rate of interest authorized under 31-1-107 from the date due until paid”

MCA 31-1-107 caps agreed interest at the greater of 15% or 6 percentage points per year above the Federal Reserve H.15 bank prime rate. ([MCA § 31-1-107(1)](https://mca.legmt.gov/bills/mca/title_0310/chapter_0010/part_0010/section_0070/0310-0010-0010-0070.html))

> Statute text “Parties may agree in writing to the payment of any rate of interest that does not exceed the greater of 15% or an amount that is 6 percentage points per year above the prime rate published by the federal reserve system in its statistical release H.15 Selected Interest Rates for bank prime loans”

## Suspense and withheld payments

The timing-and-interest section does not apply when the owner takes production in kind, or when a dispute over title to the minerals or entitlement to royalties would affect distribution of royalty payments; that section contains no escrow requirement and no provision for interest on funds held for those reasons. Separately, where a district court creates a trust for an unlocatable mineral owner, all bonuses, rentals, royalties and other income must be paid to the trustee until the trust ends (MCA 82-1-304).

Where a trust is created for unlocatable mineral owners, all bonuses, rental payments, royalties and other income must be paid to the trustee until the trust is terminated and notice given. ([MCA 82-1-304(3)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0010/part_0030/section_0040/0820-0010-0030-0040.html))

> Statute text “(3) All bonuses, rental payments, royalties, and other income must be paid to the trustee until the trust is terminated and notice of its termination given to all interested parties.”

Section 82-10-103 does not apply where the owner takes in kind, or where a dispute over mineral title or royalty entitlement would affect distribution of royalty payments. ([MCA § 82-10-103(4)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0030/0820-0100-0010-0030.html))

> Statute text “This section does not apply if a royalty owner or the owner's assignee has elected to take the owner's or assignee's proportionate share of production in kind or whenever there is a dispute as to the title of the minerals or entitlement to royalties, the outcome of which would affect distribution of royalty payments.”

## Division orders

A division order is an instrument executed by the lessor to authorize sale and direct distribution of proceeds. It may not alter or amend the lease and does not relieve the lessee of lease obligations. It must be in writing, warrant the division of interest, list each payee's name, address and tax identification number, and require notice of change of ownership.

A division order may not alter or amend the underlying lease and does not relieve the lessee of its lease obligations. ([MCA § 82-10-110(2)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0100/0820-0100-0010-0100.html))

> Statute text “A division order may not alter or amend the terms of the underlying oil or gas lease. A division order does not relieve a lessee of any liabilities or obligations under the terms of the underlying oil or gas lease.”

A division order is defined as an instrument executed by the lessor authorizing sale and directing distribution of proceeds. ([MCA § 82-10-110(1)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0100/0820-0100-0010-0100.html))

> Statute text “the term "division order" is limited to mean an instrument executed by the lessor of an oil or gas lease to authorize the sale of and direct the distribution of proceeds from the sale of oil, gas, casinghead gas, or other related hydrocarbons”

A division order must warrant the division of interest and contain the name, address and tax identification number of each interest owner paid. ([MCA § 82-10-110(3)(a)-(b)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0100/0820-0100-0010-0100.html))

> Statute text “must warrant the division of interest; (b) must contain the name, address, and tax identification number of each interest owner to whom disbursements are made”

A division order must be in writing. ([MCA § 82-10-110(3)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0100/0820-0100-0010-0100.html))

> Statute text “A division order must be in writing and:”

A division order must contain a provision requiring notice of change of ownership. ([MCA § 82-10-110(3)(c)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0100/0820-0100-0010-0100.html))

> Statute text “must contain a provision requiring notice of change of ownership”

## Owner remedies, notice and attorney fees

A royalty owner may make written demand for an accounting and for payment; if the payor fails to account and pay within 60 days, the owner may sue in the district court of the county where the lands are located, and the successful party recovers reasonable attorney fees and costs (prevailing defendants also recover fees). Separately, suits for nonpayment or for payments under 82-10-103 go to the district court where the well is located, with costs and attorney fees to the prevailing party. The royalty obligation is of the essence of the lease. The accounting remedy is in addition to other remedies.

If the payor fails to account and pay within 60 days after the owner's written demand, the owner may sue in the district court where the lands are located. ([MCA § 82-10-101(1)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0010/0820-0100-0010-0010.html))

> Statute text “fail to make the accounting demanded and the payment or delivery of the royalty due within a period of 60 days following the date upon which said demand is made, then the owner of said royalty may file an action in the district court of the county wherein said lands are located”

The successful party in the accounting action recovers reasonable attorney fees and costs. ([MCA § 82-10-101(2)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0010/0820-0100-0010-0010.html))

> Statute text “also recover judgment for a sum of money by way of reasonable attorney fees to be allowed by the court together with the costs allowed to successful parties by law”

If the defendant prevails, the court awards the defendant reasonable attorney fees and costs against the unsuccessful plaintiff. ([MCA § 82-10-101(4)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0010/0820-0100-0010-0010.html))

> Statute text “If the defendant or defendants prevail in said action against any one or more of said plaintiffs, the court shall adjudge and allow to such defendant or defendants and against the unsuccessful plaintiff or plaintiffs recovery of a sum of money as reasonable attorney fees”

The accounting remedy is additional to, not a substitute for, other remedies. ([MCA § 82-10-102](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0020/0820-0100-0010-0020.html))

> Statute text “The remedy provided for in 82-10-101 is in the nature of a special remedy additional to and not a substitute for other remedies given by law to owners of royalties”

A royalty owner seeking a remedy for nonpayment, or payments under 82-10-103, must sue in the district court of the county where the well is located. ([MCA § 82-10-103(3)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0030/0820-0100-0010-0030.html))

> Statute text “A royalty owner seeking a remedy for failure to make payments under the lease or seeking payments under this section shall bring the action in the district court for the county in which the oil or gas well is located”

The prevailing party in a proceeding under 82-10-103 recovers court costs and reasonable attorney fees. ([MCA § 82-10-103(3)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0030/0820-0100-0010-0030.html))

> Statute text “The prevailing party in any proceeding brought under this section is entitled to recover court costs and reasonable attorney fees.”

The obligation to pay royalties is of the essence in the lease contract. ([MCA § 82-10-103(1)](https://mca.legmt.gov/bills/mca/title_0820/chapter_0100/part_0010/section_0030/0820-0100-0010-0030.html))

## Unclaimed royalties (escheat)

Montana's Unclaimed Property Act defines 'mineral proceeds' to include royalties and overriding royalties, but its abandonment schedule has no category specifically for mineral proceeds; the catch-all for 'all other property' is five years after the owner's right to demand or the obligation to pay arises, whichever first occurs. The administrator is the Montana Department of Revenue.

'Mineral proceeds' includes royalties, overriding royalties, net revenue interests and production payments for the extraction, production or sale of minerals. ([MCA § 70-9-802(10)(b)](https://mca.legmt.gov/bills/mca/title_0700/chapter_0090/part_0080/section_0020/0700-0090-0080-0020.html))

> Statute text “for the extraction, production, or sale of minerals, including net revenue interests, royalties, overriding royalties, extraction payments, and production payments”

All other property is presumed abandoned five years after the owner's right to demand it or the obligation to pay arises, whichever first occurs. ([MCA § 70-9-803(1)(q)](https://mca.legmt.gov/bills/mca/title_0700/chapter_0090/part_0080/section_0030/0700-0090-0080-0030.html))

> Statute text “all other property, 5 years after the owner's right to demand the property or after the obligation to pay or distribute the property arises, whichever first occurs”

The administrator under the act is the Department of Revenue. ([MCA § 70-9-802(1)](https://mca.legmt.gov/bills/mca/title_0700/chapter_0090/part_0080/section_0020/0700-0090-0080-0020.html))
