The Delaware Basin is one of the most active and valuable drilling regions in North America. Minerals in Lea and Eddy counties can command premium prices due to the stacked pay potential (multiple productive formations), active operator development, and proven reserves. Many Denver-based operators are very active here, so the economics are well understood.
Both states have income taxes. New Mexico taxes non-resident income from New Mexico sources, including mineral royalties. Colorado also taxes your mineral income. When you sell, you may owe capital gains tax to both states (though Colorado typically provides a credit for taxes paid to other states). A CPA familiar with both states can help you plan.
New Mexico has significant federal land ownership, and some surface landowners receive royalties from federal minerals leased by the BLM. Private mineral ownership works differently.
